In these Terms:

  • “Edimays Couture,” “we,” “us” and “our” refer to the business identified above;

  • “customer,” “you” and “your” refer to the person accessing the website or placing an order;

  • “website” means edimayscouture.com and its related pages and services;

  • “product” means any garment, accessory or other item offered for sale by Edimays Couture; and

  • “order” means a request submitted by you to purchase one or more products.

By accessing the website, creating an account or placing an order, you agree to be bound by these Terms and our:

  • Privacy Policy;

  • Cookie Policy;

  • Shipping and Delivery Policy;

  • Returns and Defective Products Policy; and

  • any other policies displayed on the website.

Where there is a conflict between these Terms and a mandatory provision of applicable law, the mandatory legal provision will prevail.

2. Eligibility

You must be at least 18 years old or have reached the legal age required to enter into a binding contract in your country.

Where a person below the applicable legal age uses the website, the person must do so with the involvement and permission of a parent or legal guardian.

By placing an order, you confirm that:

  • you are legally capable of entering into a binding contract;

  • the information you provide is complete and accurate;

  • you are authorised to use the selected payment method; and

  • you are purchasing for lawful personal or business purposes.

We may refuse or cancel an order where we reasonably believe that the order was submitted by a person who lacks legal capacity or authority.

3. Customer Accounts

You may be required to create an account to access certain website features.

You agree to:

  • update your information when it changes;

  • maintain the confidentiality of your password;

  • prevent unauthorized access to your account; and

  • notify us promptly if you suspect unauthorized access or misuse.

4. Product Information

We make reasonable efforts to ensure that product descriptions, photographs, sizes, colours, materials, prices and availability are accurate.

However:

  • colours may appear differently depending on your screen, lighting and device settings;

  • handmade, patterned or limited-production garments may contain minor variations;

  • placement of prints or patterns may differ between individual garments;

  • measurements may vary slightly because of production methods;

  • accessories shown in styling photographs may not be included unless expressly stated; and

  • product packaging may change without affecting the product itself.

A minor variation that does not materially affect the product’s quality, identity or intended use will not ordinarily constitute a defect.

Please review the product description, size guide, measurements, care instructions and delivery estimate before ordering.

5. Sizing and Fit

Customers are responsible for selecting the appropriate size using the size guide and measurements provided on the website.

General size labels such as Small, Medium, Large or Extra Large may vary between brands and garment designs. You should rely primarily on the measurements and fit information displayed for the particular product.

Unless the product itself is defective or incorrectly supplied, selecting an unsuitable size does not automatically entitle a customer to a return, exchange or refund under Edimays Couture’s voluntary return policy.

Where sizing information displayed on the website was materially inaccurate and directly caused the incorrect fit, contact us so that we can assess the matter.

6. Product Availability

All products are subject to availability.

Placing an item in your shopping basket does not reserve it. A product may become unavailable before checkout is completed or payment is confirmed.

We may:

  • limit the quantity of a product that may be purchased;

  • discontinue a product;

  • correct an inventory error;

  • reject unusually large or suspicious orders; or

  • cancel an order for a product that is unavailable.

Where payment has already been received for an unavailable product, we will offer an appropriate alternative or issue a refund for the unavailable item.

7. Prices and Currency

Product prices will be displayed on the website in the applicable currency.

Unless stated otherwise:

  • prices exclude delivery charges;

  • international prices may exclude customs duties, import taxes and clearance charges;

  • the total amount payable will be displayed before you submit your order; and

  • promotional prices apply only during the stated promotional period.

Where the website provides currency conversion, the converted amount may be an estimate. Your bank, card issuer, mobile-money provider or payment processor may apply its own:

  • exchange rate;

  • conversion fee;

  • international transaction fee; or

  • processing charge.

Edimays Couture does not control charges imposed independently by your payment provider.

8. Pricing and Website Errors

We may correct typographical, pricing, description, inventory or technical errors at any time.

Where a product was listed at an obviously incorrect price, we may contact you before accepting or fulfilling the order.

You may choose to:

  • proceed at the corrected price; or

  • cancel the affected item or order.

If we cancel an order because of an error after payment has been received, we will refund the amount paid for the cancelled item.

We will not rely on this section to change a correctly displayed and accepted price merely because the product later becomes more expensive.

9. Placing an Order

To place an order, you must:

  1. select the product, size, colour and quantity;

  2. provide accurate billing and delivery information;

  3. select a delivery method;

  4. select an available payment method;

  5. review the total amount payable;

  6. accept these Terms; and

  7. submit the order.

You are responsible for reviewing the order before submission.

Submitting an order constitutes an offer to purchase the selected products. It does not necessarily mean that we have accepted the order.

10. Order Acceptance and Formation of Contract

After you place an order, we may send an automated acknowledgement confirming receipt of your order.

An automated acknowledgement does not by itself mean that the order has been accepted.

A binding sales contract is formed when we:

  • expressly confirm acceptance of the order;

  • confirm that the product has been prepared or dispatched; or

  • otherwise begin performing the order,

whichever occurs first.

We may reject or cancel an order before acceptance for reasons including:

  • product unavailability;

  • an incorrect price or description;

  • unsuccessful payment;

  • suspected fraud;

  • unauthorized use of a payment method;

  • inability to deliver to the address provided;

  • breach of these Terms;

  • legal or regulatory restrictions; or

  • circumstances reasonably beyond our control.

11. Order Confirmation

After accepting an order, we will normally provide an electronic confirmation containing relevant details such as:

  • the order number;

  • products ordered;

  • quantities and sizes;

  • billing and delivery information;

  • price;

  • delivery charge;

  • payment status; and

  • estimated delivery information.

You should review the confirmation promptly and contact us if any information is incorrect.

12. Changes and Cancellations

Once an order has been confirmed, it may enter processing immediately.

A request to change or cancel an order must be submitted as soon as possible through:

We do not guarantee that a confirmed order can be changed or cancelled.

An order cannot ordinarily be changed or cancelled after it has been:

  • cut or altered at your request;

  • personalized;

  • packaged for dispatch;

  • handed to a courier; or

  • dispatched.

Where we approve a customer-requested cancellation before dispatch, reasonable non-refundable payment-processing or administrative charges may be deducted only where permitted by law and clearly communicated.

Nothing in this section limits a cancellation or remedy that must be provided under applicable law.

13. Custom, Altered and Made-to-Order Products

Where Edimays Couture accepts an order for a customized, altered, personalized or made-to-order product, you are responsible for providing accurate:

  • measurements;

  • design selections;

  • colours;

  • personalization details;

  • delivery requirements; and

  • other requested specifications.

You must review and approve any measurements, sketches, samples or specifications submitted for confirmation.

Custom, altered and made-to-order products cannot ordinarily be cancelled, returned or exchanged because of:

  • a change of mind;

  • an incorrect measurement supplied by the customer;

  • an incorrect size selected by the customer;

  • a preference change; or

  • a delay caused by incomplete or late customer instructions.

This exclusion does not apply where the product:

  • is defective;

  • materially differs from the approved specification;

  • was made using measurements incorrectly recorded by Edimays Couture; or

  • otherwise fails to meet a mandatory legal standard.

14. Payment Methods

We accept payment through the methods displayed at checkout, which may include:

  • mobile money;

  • debit cards;

  • credit cards; and

  • other approved electronic payment methods.

Available methods may vary depending on your country, currency and order value.

Independent payment-service providers may process payments. Those providers may apply their own terms, privacy notices, verification procedures and security requirements.

15. Payment Authorization

By submitting payment information, you confirm that:

  • you are authorized to use the selected payment method;

  • the payment information is accurate;

  • sufficient funds or credit are available; and

  • our payment provider or we may process the transaction.

We may delay fulfilment until payment has been successfully authorized and confirmed.

Where payment is:

  • declined;

  • reversed;

  • disputed;

  • flagged for verification; or

  • not received in full,

we may suspend or cancel the order.

16. Mobile-Money Payments

For mobile-money payments, you are responsible for:

  • entering the correct mobile-money number;

  • approving the payment request;

  • completing any required authentication;

  • confirming the amount before approval; and

  • protecting your mobile-money PIN and account credentials.

Edimays Couture will never require you to disclose your mobile-money PIN.

A payment is not complete merely because a debit alert appears on your device. The transaction must also be confirmed through our payment system.

Where your account is debited but the order is not confirmed, contact us with:

  • your name;

  • order number, if available;

  • transaction reference;

  • amount;

  • payment date; and

  • the telephone number used for payment.

Do not send your PIN, one-time password, complete card number or other confidential authentication details.

17. Card Payments

Card payments may require authentication through your card issuer.

We do not ordinarily receive or store complete card numbers or card security codes. Card information is handled by the relevant payment provider in accordance with its security and legal obligations.

Your card issuer may apply:

  • verification holds;

  • currency conversion;

  • international transaction fees; or

  • other charges.

Questions concerning those charges should be directed to the card issuer.

18. Fraud Prevention and Payment Verification

We may conduct reasonable verification before accepting or dispatching an order.

We may request information necessary to confirm:

  • the customer’s identity;

  • payment authorization;

  • the billing address;

  • the delivery address; or

  • the legitimacy of the transaction.

We will not request your card security code, mobile-money PIN or banking password by email, telephone, social media or messaging application.

Where verification is not completed, we may delay or cancel the order and refund any verified amount received.

19. Delivery Areas

Edimays Couture provides:

  • local delivery within Ghana; and

  • international delivery to supported countries.

Available destinations will be displayed at checkout or confirmed before the order is accepted.

We may decline delivery to:

  • restricted locations;

  • locations not served by our courier partners;

  • addresses affected by legal or trade restrictions;

  • addresses that cannot be reasonably verified; or

  • destinations for which secure delivery cannot be arranged.

20. Delivery Information

You must provide a complete and accurate delivery address, including where applicable:

  • recipient’s full name;

  • telephone number;

  • house or building information;

  • street or digital address;

  • area, town or city;

  • region or state;

  • postal code;

  • country; and

  • relevant delivery instructions.

Edimays Couture is not responsible for delay, failed delivery or additional charges caused by incomplete or inaccurate information supplied by the customer.

Contact us immediately if you discover an address error. We cannot guarantee that an address can be changed after dispatch.

21. Delivery Charges

Delivery charges are calculated based on factors that may include:

  • destination;

  • parcel size;

  • parcel weight;

  • courier;

  • delivery speed; and

  • applicable surcharges.

The delivery charge will be displayed at checkout or communicated before the order is accepted.

Additional charges resulting from an incorrect address, failed delivery or customer-requested redirection may be payable by the customer, except where the problem was caused by Edimays Couture or its delivery provider.

22. Delivery Estimates

Any delivery date or period provided is an estimate unless expressly confirmed as guaranteed.

Delivery times may be affected by:

  • product processing;

  • made-to-order production;

  • weekends and public holidays;

  • weather;

  • transportation disruption;

  • courier delays;

  • customs procedures;

  • security incidents;

  • incorrect delivery information;

  • recipient unavailability; or

  • circumstances beyond our reasonable control.

We will make reasonable efforts to keep you informed of a material delay.

A delay does not automatically entitle a customer to compensation, but nothing in these Terms limits any remedy required by applicable law.

23. Local Delivery Within Ghana

For local deliveries:

  • the recipient may be contacted before or during delivery;

  • the recipient may be required to provide directions;

  • proof of delivery may be recorded;

  • identification or an order reference may be requested; and

  • redelivery charges may apply following an unsuccessful attempt caused by the recipient.

You should inspect the parcel as soon as reasonably practicable after receiving it.

24. International Delivery

International orders may be subject to:

  • customs inspection;

  • import duties;

  • import taxes;

  • value-added taxes;

  • brokerage charges;

  • clearance fees;

  • handling fees; and

  • local regulatory requirements.

Unless checkout expressly states that these charges are included, international customers are responsible for charges imposed by the destination country.

Customs authorities may require personal information such as the recipient’s:

  • full name;

  • address;

  • telephone number;

  • email address;

  • identification or tax number; and

  • order value.

Edimays Couture does not control customs decisions or clearance timelines.

25. Customs Refusal and Unpaid Import Charges

Where an international customer:

  • refuses to pay applicable import charges;

  • refuses the parcel;

  • fails to complete customs clearance;

  • supplies incorrect customs information; or

  • fails to collect the parcel,

the parcel may be abandoned, destroyed or returned to us.

Where the parcel is returned, any refund will be assessed after the product is received and inspected.

Subject to applicable law, we may deduct reasonable amounts actually incurred, including:

  • outbound delivery costs;

  • return delivery costs;

  • customs charges;

  • brokerage fees;

  • storage charges; and

  • non-refundable payment-processing costs.

No refund will be available where the parcel is lawfully destroyed or abandoned and Edimays Couture cannot recover the product, except where the failure resulted from our error.

26. Risk and Ownership

Risk of loss or damage transfers in accordance with applicable law.

Subject to any mandatory legal rule, ownership of a product generally passes to you after:

  • full payment has been received; and

  • the product has been delivered to you or a person authorized by you.

Delivery to a reception desk, household member, employee, security officer, collection point or other person authorized or reasonably appearing authorized to receive the parcel may constitute delivery.

27. Delivery Inspection

When receiving a parcel, you should check whether:

  • the packaging is visibly damaged;

  • the parcel appears opened or tampered with;

  • the correct number of items is present; and

  • the products appear damaged or incorrect.

Where possible, report visible parcel damage to the courier before accepting delivery and retain evidence.

You should contact Edimays Couture promptly with photographs or videos where a product is:

  • damaged in transit;

  • defective;

  • incorrect;

  • incomplete; or

  • materially different from what was ordered.

28. Returns Policy

Edimays Couture does not ordinarily accept returns, exchanges or refunds for:

  • change of mind;

  • incorrect size selected by the customer;

  • incorrect colour selected by the customer;

  • personal preference;

  • an unwanted gift;

  • failure to review product information;

  • minor colour differences caused by screen display;

  • minor pattern-placement variations; or

  • normal characteristics of handmade or patterned garments.

Returns are accepted only where a product:

  • has a manufacturing defect;

  • arrives damaged;

  • is materially different from its description;

  • is not the product ordered;

  • is missing a material component; or

  • otherwise qualifies for a remedy under applicable law.

This policy does not exclude or restrict any right or remedy that cannot lawfully be excluded.

29. What Constitutes a Defect

A defect may include:

  • torn or damaged fabric present at delivery;

  • broken fastenings;

  • defective stitching that materially affects use;

  • missing material components;

  • a material manufacturing fault;

  • substantial inconsistency with the product description;

  • an incorrect product, size or colour supplied by Edimays Couture; or

  • damage occurring before delivery.

The following will not ordinarily constitute defects:

  • normal wear and tear;

  • damage caused after delivery;

  • failure to follow care instructions;

  • improper washing, drying, ironing or storage;

  • staining;

  • accidental tearing;

  • alteration by the customer or a third party;

  • damage caused by jewellery, bags or other objects;

  • incorrect size selection;

  • natural textile variations;

  • minor loose threads that do not affect construction;

  • minor differences in pattern placement; or

  • reasonable colour differences caused by photography, lighting or screen settings.

30. Reporting a Defective or Incorrect Product

You must inspect the product promptly after delivery.

A suspected defect, incorrect item or delivery damage should be reported within 48 hours or 2 days after delivery.

Your report should include:

  • order number;

  • full name;

  • product name;

  • description of the problem;

  • date the product was received;

  • clear photographs or video;

  • photograph of the packaging, where relevant; and

  • any other reasonably requested information.

Failure to report within the stated period will not remove a mandatory statutory right relating to a latent defect that could not reasonably have been discovered earlier.

31. Return Authorization

Do not return a product without first contacting Edimays Couture.

Where the initial information indicates that a product may be eligible, we will provide:

  • return authorization;

  • the return address;

  • packaging instructions;

  • the applicable return period; and

  • information about return delivery.

An authorization does not guarantee a refund or replacement. The product must first be received and inspected.

Unauthorized returns may be refused or returned to the sender.

32. Conditions for Returning a Defective Product

Unless impracticable because of the defect, the product should be returned:

  • unworn, except for reasonable inspection or fitting;

  • unwashed;

  • unaltered;

  • with original tags;

  • with original packaging where available;

  • with accessories supplied with it; and

  • within 7 days after return authorization.

A customer may reasonably inspect and try on a product to determine its nature, fit and condition. This does not permit extended use.

We may reject a defect claim where inspection reasonably establishes that the problem resulted from customer misuse, accidental damage, alteration or failure to follow care instructions.

33. Return Delivery Costs

Where inspection confirms that:

  • the product was defective;

  • the wrong product was supplied; or

  • the product was damaged before delivery,

Edimays Couture will bear or reimburse reasonable approved return-delivery costs.

You must use the return method approved by Edimays Couture unless otherwise agreed.

We may decline to reimburse:

  • premium or expedited return delivery selected without approval;

  • avoidable customs charges;

  • incorrectly addressed returns; or

  • return costs for a product that is found not to be defective.

Where a claim is rejected after inspection, you may be required to pay the cost of returning the product to you.

34. Remedies for Confirmed Defects

Where a defect or incorrect supply is confirmed, Edimays Couture may provide an appropriate remedy, subject to the circumstances and applicable law.

Available remedies may include:

  • repair;

  • replacement;

  • correction;

  • exchange for the correct product;

  • store credit;

  • partial refund; or

  • full refund.

The appropriate remedy will depend on:

  • the nature and seriousness of the defect;

  • whether the product can reasonably be repaired;

  • replacement availability;

  • the customer’s legal rights;

  • the period since delivery; and

  • whether the product has been accepted or materially used.

Where applicable law entitles you to choose a particular remedy, these Terms do not remove that right.

35. Refunds

Approved refunds will normally be issued through the original payment method.

Where this is not technically possible, we may request verified information for an alternative lawful refund method.

Refund processing may take 7 days after approval. Your bank, card issuer, or mobile money provider may require additional time to credit the funds.

We are not responsible for processing delays caused solely by a financial institution after the refund has been properly submitted.

Unless required by law, we do not refund:

  • original delivery costs for a non-defective product;

  • customs duties paid directly to an authority;

  • currency conversion charges;

  • card-issuer charges;

  • bank charges; or

  • unapproved return-delivery costs.

Where the entire order is rejected because of a confirmed defect or our material error, the treatment of delivery charges will be determined in accordance with applicable law.

36. Hygiene and Product Integrity

For health, hygiene and product-integrity reasons, certain products may not be returnable after their protective seal has been removed or where they have been worn directly against the body.

This restriction does not apply where the product is defective or where a mandatory legal right requires a remedy.

Any hygiene-based exclusion will be clearly stated on the relevant product page where applicable.

37. Promotions and Discount Codes

Promotions and discount codes:

  • apply only during the stated period;

  • may be limited to particular products or customers;

  • cannot be exchanged for cash;

  • may not be combined unless expressly permitted;

  • may be limited to one use per person or order;

  • must be entered before checkout is completed; and

  • may be withdrawn or corrected where issued or advertised in error.

A promotion does not reduce your mandatory rights regarding defective products.

Where a refunded order used a discount code, the refund will be based on the amount actually paid for the affected product.

38. Gift Cards and Store Credit

Where gift cards or store credit are offered:

  • they may be used only through authorized Edimays Couture sales channels;

  • they cannot be exchanged for cash except where required by law;

  • they must not be resold without permission;

  • they may be subject to stated expiry rules; and

  • lost or stolen codes may not be replaceable unless ownership and unused value can be verified.

Specific gift-card conditions displayed at purchase form part of these Terms.

39. Intellectual Property

All content on the website is owned by or licensed to Edimays Couture, including:

  • brand names;

  • logos;

  • trademarks;

  • product names;

  • photographs;

  • videos;

  • garment designs;

  • graphics;

  • illustrations;

  • website layouts;

  • text;

  • product descriptions; and

  • software-related content.

You may access and use the website for lawful personal shopping purposes.

You may not, without prior written permission:

  • reproduce website content;

  • copy product photographs;

  • republish product descriptions;

  • use our branding;

  • create derivative commercial works;

  • scrape or systematically extract website content;

  • use content to train commercial systems;

  • remove ownership notices; or

  • sell, license or commercially exploit our content.

Nothing in these Terms transfers intellectual-property ownership to you.

40. Customer Reviews and Submitted Content

Where you submit a review, photograph, video, comment or other content, you confirm that:

  • you created it or have permission to submit it;

  • it is accurate to the best of your knowledge;

  • it does not infringe another person’s rights;

  • it is not defamatory, unlawful or misleading; and

  • it does not contain confidential information you are not authorized to disclose.

You grant Edimays Couture a non-exclusive, worldwide, royalty-free license to use, reproduce and display the submitted content for operating and promoting the business, subject to applicable privacy and consumer-protection laws.

We will obtain any additional consent required before using identifiable customer photographs in advertising.

We may remove submitted content that violates these Terms.

41. Acceptable Use

You must not:

  • use the website unlawfully;

  • submit false or misleading information;

  • impersonate another person;

  • use a payment method without authority;

  • introduce malware or harmful code;

  • interfere with website security;

  • attempt unauthorized access;

  • scrape the website through automated means without permission;

  • abuse promotions, refunds or chargebacks;

  • submit fraudulent orders;

  • harass staff or other customers;

  • infringe intellectual-property rights; or

  • use the website in a manner that damages Edimays Couture or another person.

We may restrict or terminate access where these requirements are breached.

42. Third-Party Services

Third parties operate under their own terms and privacy notices.

Edimays Couture is not responsible for an independently operated third-party service, except to the extent that liability cannot lawfully be excluded or where the third party acts on our behalf and we remain legally responsible.

We aim to maintain a reliable website but do not guarantee uninterrupted or error-free access.

The website may be unavailable because of:

  • maintenance;

  • software updates;

  • hosting failures;

  • internet disruption;

  • security incidents;

  • third-party outages; or

  • circumstances beyond our control.

We may modify, suspend or discontinue a website feature where reasonably necessary.

This does not affect an order that has already formed a binding contract, except where performance is prevented by circumstances recognized under applicable law.

44. Security

You must not attempt to defeat or bypass website security.

Although we use reasonable safeguards, no internet service can be guaranteed completely secure.

You should:

  • use a strong and unique password;

  • keep authentication credentials private;

  • use secure devices and networks;

  • verify that you are using edimayscouture.com; and

  • notify us promptly of suspected fraud.

45. Privacy

Our collection and use of personal information are explained in our Privacy Policy and Cookie Policy.

By using the website, you acknowledge that your personal information will be processed as described in those policies and in accordance with applicable law.

We may share information with payment, delivery, hosting, communications and other service providers where necessary to process and fulfil orders.

46. Disclaimer of Warranties

We do not exclude any warranty, condition, guarantee or right that cannot lawfully be excluded.

Subject to that qualification:

  • the website is provided on an “as available” basis;

  • general styling information is not professional or medical advice;

  • sizing recommendations are estimates;

  • we do not guarantee that a particular style will meet every customer’s subjective preference; and

  • minor non-material product variations may occur.

No provision of these Terms excludes implied legal conditions concerning matters such as title, description, quality or fitness where applicable law prohibits exclusion.

47. Limitation of Liability

Nothing in these Terms excludes or limits liability for:

  • fraud or fraudulent misrepresentation;

  • willful misconduct;

  • death or personal injury caused by negligence where liability cannot be excluded;

  • breach of mandatory consumer rights;

  • liability that applicable law does not permit us to exclude; or

  • any other non-excludable obligation.

Subject to those exceptions, Edimays Couture will not be liable for indirect, incidental or consequential loss that was not reasonably foreseeable when the contract was formed.

For business customers, and to the extent permitted by law, our total liability arising from a particular order will not exceed the amount paid for that order.

The preceding financial limit does not apply to consumers where applying it would unlawfully restrict a mandatory remedy.

48. Customer Responsibility for Loss

You may be responsible for reasonable loss or expense resulting from:

  • fraudulent information;

  • unauthorized payment use;

  • intentional misuse;

  • an incorrect address;

  • refusal to complete customs clearance;

  • infringement of another person’s rights; or

  • a material breach of these Terms.

You will not be responsible to the extent that the loss resulted from our negligence, breach of contract or legal non-compliance.

49. Events Beyond Reasonable Control

Neither party will be responsible for delay or failure caused by an event beyond reasonable control, which may include:

  • natural disasters;

  • severe weather;

  • epidemic or pandemic restrictions;

  • war;

  • civil disturbance;

  • strikes;

  • transportation disruption;

  • customs action;

  • government restrictions;

  • internet or telecommunications failure;

  • power failure;

  • cyberattack; or

  • failure of an essential third-party service.

The affected party must take reasonable steps to reduce the impact.

If the delay becomes substantial, either party may have rights to cancel the unperformed portion of the contract, subject to applicable law.

  • your name;

  • order number;

  • description of the issue;

  • relevant photographs or documents; and

  • the resolution requested.

We will acknowledge and investigate complaints within a reasonable period.

51. Chargebacks and Payment Disputes

Before initiating a chargeback or payment reversal, please contact us and allow a reasonable opportunity to investigate.

Nothing in this section removes your right to contact your payment provider or exercise a lawful chargeback right.

However, submitting false information, claiming that an authorized order was unauthorized or retaining delivered goods after obtaining an improper reversal may constitute fraud.

We may provide the payment provider with relevant order, delivery and communication records when responding to a dispute.

52. Governing Law

These Terms and any contract between you and Edimays Couture are governed by the laws of the Republic of Ghana, including applicable laws governing contracts, electronic transactions and sale of goods.

Where mandatory consumer law in your country applies despite this choice of law, this section does not deprive you of protections that cannot lawfully be excluded by agreement.

53. Dispute Resolution

We encourage customers to contact us first so that disputes can be resolved informally.

If a dispute cannot be resolved through customer support, the parties should attempt in good faith to resolve it through negotiation.

Where appropriate and agreed by the parties, the dispute may be referred to mediation in Ghana before court proceedings are commenced.

Nothing in this section:

  • prevents either party from seeking urgent court relief;

  • requires a consumer to waive a mandatory legal remedy;

  • prevents a consumer from reporting a matter to a competent regulator; or

  • excludes the jurisdiction of a court that has mandatory authority under applicable law.

Subject to those qualifications, the courts of Ghana will have jurisdiction over disputes arising from these Terms.

54. Notices

We may send notices relating to your order or these Terms through:

  • email;

  • your customer account;

  • a website notice;

  • SMS; or

  • another contact method supplied by you.

You are responsible for keeping your contact information current.

55. Changes to These Terms

We may update these Terms to reflect changes in:

  • our products;

  • our business operations;

  • payment or delivery arrangements;

  • technology;

  • applicable laws; or

  • regulatory guidance.

The revised Terms will be published with a new “Last updated” date.

Changes will generally apply to orders placed after the revised Terms take effect.

The terms applicable to an existing order will ordinarily be those accepted when the order was placed, unless:

  • a change is required by law;

  • the change benefits the customer; or

  • the parties agree otherwise.

56. Assignment

You may not transfer your rights or obligations under an order without our written consent.

We may transfer our rights or obligations as part of a legitimate restructuring, business sale or service arrangement, provided that the transfer does not reduce your mandatory rights.

57. Severability

If any provision of these Terms is found to be illegal, invalid or unenforceable, that provision will be interpreted or limited to the minimum extent necessary.

The remaining provisions will continue in effect.

58. No Waiver

A failure or delay by Edimays Couture to enforce a provision does not waive the right to enforce it later.

A waiver is effective only when expressly communicated by an authorized representative.

59. Entire Agreement

These Terms, together with the policies incorporated by reference and the accepted order confirmation, form the agreement between you and Edimays Couture concerning your purchase.

They replace prior discussions or representations concerning the same transaction, except where excluding a representation would be unlawful.

60. Language

These Terms are written in English.

Where a translation is provided, it is for convenience. If there is an inconsistency, the English version will prevail to the extent permitted by applicable law.
